General information on Greek Real Estate Agents' law

It is usual that real estate agents in Greece are rewarded both from the seller and from the buyer of a property. This fee is usually 2% for the seller and 2% for the buyer plus VAT of 19%. This fee is calculated on the final and real value of the sale of the real estate. The agents' commission is only payable when the contract is concluded as a result of the agent's activity, except if the parties have agreed otherwise.

 

Agreement with Domus inc. / gb GreekBlue

 

domus inc. / gb GreekBlue does not charge its foreign buyers with any fee for the provision of its consulting services or for the purchase of a real estate. The only amount with which our foreign customers will be charged is the travel expenses of domus inc. personnel from Athens to any other part of Greece in order to accompany them and present the properties for sale. If the customer buys one of the properties that are presented by domus inc., then he will receive a full refund of the above mentioned travel expenses.

 

An investor will have to pay travel expenses to domus inc. on the day of his/her arrival in Greece. By way of exception, if an investor wishes to visit the properties using a helicopter, then he/she will have to deposit the money to a domus inc. bank account one month in advance.

 

This agreement is not valid for Greek Citizens or for those of Greek Nationality.

 

Doing business only with licensed real estate agents


Any person performing real estate agency activities in Greece must hold a valid real estate licence.


 

Liability of unlicensed real estate agents and customers' claims


Contracts possibly concluded with unlicensed real estate agents shall be treated as null and void. For the unlicensed real estate agent this means that he has no substantiated claims for the amount of the agreed commission. On the other hand, customers who have already paid an unlawful commission may put forward claims of unjust enrichment of the unlicensed agent requesting refund of the unduly paid fees.

Apart from the enforcement of the agent's fees, the unlicensed agents may be held criminally liable for fraudulent misrepresentation of facts and professional qualifications. Criminal liability may also occur with view to tax offences (tax evasion, etc.), since real estate agents, irrespective of their nationality or permanent residence, are liable to Greek income tax and are under a Greek bookkeeping obligation.
